Active agent against insolvency? The new possibilities of preventive restructuring in the lockdown and solutions for the time after.
Thanks to the modernisation of German insolvency law, the new Act on the Stabilisation and Restructuring of Companies (StaRUG) was passed in December 2020, creating a modern tool. It enables companies to ensure the restructuring of their finances at an early stage, i.e. not only when they are really insolvent.
In addition to the obligations for early crisis detection, this includes, above all, talking about transparency through liquidity and scenario planning and discussing liquidity support as well as mandatory action measures.
