Settlement in the Zakrzówek Case in Kraków – resolution of a long-running dispute with the City of Kraków

The settlement in the Zakrzówek case in Kraków brings to an end a long-running dispute between our Client and the Municipality of the City of Kraków concerning real estate properties located in Zakrzówek, Kraków.
Under the terms of the agreement, the Client received PLN 53 million (gross), while the properties owned by the Client, covering more than 9 hectares in Zakrzówek, were transferred to the City of Kraków. The settlement definitively resolves one of the most widely discussed disputes in Kraków concerning zoning restrictions and environmental protection regulations.
The source of the conflict was a resolution adopted by the Kraków City Council in 2018, which designated the Zakrzówek area as an ecological site.
The regulations introduced by this resolution significantly restricted the possibility of using the properties. In practice, they led to a situation where the implementation of any investment became impossible, despite the fact that the applicable local zoning plan for Zakrzówek allowed, among other things, residential and commercial development in this area.
As a result of these restrictions, the ability to use the properties was substantially impaired, which constituted the basis for claims against the City of Kraków for damages resulting from zoning restrictions.
Due to the regulations introduced, the Client filed claims seeking compensation for the limitation of proprietary rights.
The dispute concerned, among other things:
• the legal consequences of establishing an ecological site in the Zakrzówek area,
• restrictions on the possibility of carrying out an investment consistent with the local zoning plan,
• the liability of a local government authority for damages resulting from planning decisions.
The dispute concerning investment land in Zakrzówek, Kraków attracted significant public attention from the outset and was widely discussed in the media.
As a result of intense negotiations conducted under the supervision of a Mediator between representatives of the Client and the City of Kraków, the parties managed to reach a settlement ending the long-running dispute over real estate in Zakrzówek.
The agreement allowed for the final resolution of the proceedings and clarification of the legal status of the Zakrzówek area.
At every stage of the case act legal Poland provided the Client with comprehensive legal support in a dispute with a local government authority.
