Piotr Pośnik, Partner, Attorney-at-Law, and Dariusz Pacura, Senior Associate, Attorney-at-Law, achieved a 100% success rate in proceedings before the National Appeal Chamber (KIO) while representing a client from the energy sector.

Since 2025, we have been advising and representing SAKS-POL in complex public procurement appeal proceedings in Poland. The client entrusted us with four separate cases before the National Appeal Chamber (Krajowa Izba Odwoławcza – KIO) — all of which resulted in favorable rulings. These decisions enabled our client either to secure public contracts or to significantly strengthen its position in the tender process.

In its latest ruling of January 23, 2026, despite numerous objections raised by the appellant, the National Appeal Chamber fully agreed with our arguments and refused to allow the rejection of our client’s bid, which had previously been evaluated as the most economically advantageous. As a result, the client maintained a genuine and legally protected opportunity to secure the contract.

In the remaining three cases, we supported the client at every stage of the KIO appeal procedure, acting in all procedural roles available to contractors:
• as the appellant – eliminating barriers restricting participation in the public procurement procedure,
• as a party joining the appellant – supporting actions aimed at verifying the legality of the evaluation and selection of competing bids,
• as a party joining the contracting authority – defending the selection of our client’s bid and overseeing the process leading to contract award and conclusion.

This is another example that confirms our comprehensive legal support for contractors in public procurement law. Our strategic approach strengthens our clients’ position in procurement procedures and significantly increases their chances of successfully securing public contracts and future contract awards.
