After a two-year legal battle, the Warsaw Regional Court has dismissed, in a final judgment at the second-instance level, the appeal filed by the housing cooperative, upholding the earlier ruling that rejected the claim against Profit Development Group. The dispute concerned ownership rights to the land on which a residential development was built. A key role in the case was played by the principle of public credibility of the land and mortgage register, which safeguards stability and legal certainty in real estate transactions.

Our role? Comprehensive legal advice, representation of the Client in both court instances, actions aimed at ensuring continuity of business processes and minimizing costs for the Client, as well as securing the interests of apartment buyers – including the development of a pioneering insurance policy to protect their rights.

"Our cooperation with the Client in this matter went beyond purely litigation aspects and focused on developing a comprehensive set of solutions to ensure the safety of both the Client and the apartment buyers. We are particularly pleased with the positive final judgment, especially in the context of protecting the interests of apartment buyers. For both Profit Development and for us, the social aspect and achieving a fair resolution efficiently were the most important goals in this case,” said Marek Wojnar, attorney-at-law, managing partner, act legal Poland
