Artificial intelligence is increasingly becoming part of HR, customer-facing processes, analytics, and decision-making. As AI adoption continues to grow, so do questions surrounding legal liability, transparency, data protection, and regulatory compliance.

In the latest issue of TREND magazine, Milan Malata, Managing Partner of act legal Slovakia, discusses the legal and regulatory challenges associated with implementing AI in the corporate environment.

The argument that ‘AI made the decision’ is not a legal defence. An employer cannot avoid liability by claiming that an algorithm made the decision. Technology can support business processes, but it cannot override the fundamental principle that employees remain rights holders and not merely objects of control,” says Milan Malata.

In the article, he explains why the GDPR represents only one part of a broader regulatory framework that companies must consider when deploying AI solutions and outlines the practical implications that the new European AI Act will have on the business environment.

In the coming years, disputes relating to inaccurate AI outputs, discriminatory outcomes, data breaches, and flawed business decisions based on or supported by AI are likely to become increasingly common,” says Milan Malata.

An increasing number of organisations across industries are currently addressing the implementation of AI. At act legal, we help clients identify and manage the legal risks associated with the deployment and use of artificial intelligence - from regulatory compliance and data protection to contractual arrangements, employment law matters, and broader compliance considerations.
